New Zealand Court Rules In Favour of Poker

In landmark ruling for the case for poker being a skill-based game, a New Zealand court has ruled that .net advertisements are not promotions for gambling operators, and that poker tournaments themselves are not gambling but a form of competition.

The Department of Internal Affairs recently brought charges under the Gambling Act 2003 against TVWorks Limited (which owns the television stations TV3 and C4). The DIA claimed that a number of advertisements for PokerStars.net (the play-for-free site) promoted an overseas gambling operator (PokerStars.com or PokerStars or APPT) or alternatively that the advertisements were likely to induce New Zealanders to gamble overseas.

In the first case of its kind, his Honor Justice David J Harvey has dismissed all of the charges.

New Jersey Committee Approves Intrastate Gaming Bill

France Approves Bill to Make Online Poker Legal

The French parliament has approved a bill to regulate and legalize online gambling, including online poker. The new law is expected to come into force next year, and up to 100 operators are expected to apply for licenses. In an unexpected twist, an amendment was added to the bill which stipulated that any company wishing to apply for a license must close their current French player accounts for six months before they can be licensed. Another amendment means that only those online gambling operators that do not have subsidiaries or operations in tax havens (such as Gibraltar) can be considered for a license.

Seized Online Poker Funds May Not Be Returned for Years

The case that began in June of 2009 looks as if it may go unresolved for years. When more than $30 million in online poker funds were seized in June 2009 by the Southern District Court of New York on behalf of the U.S. Department of Justice, there were holes in the case, as warrants were not presented in all cases and the banks that forfeited the money were not well-informed. However, with one of the payment processors affected being recently denied its claim to $13 million of that money, the ongoing Rennick case may deter any reimbursement for up to several years.The funds were originally seized from banks like Wells Fargo and Alliance Bank in an attempt to put a stop to payment processors who were transferring money on behalf of online poker players to and from online poker sites.

Massachusetts Residents Look to Get Online Poker on 2010 Ballot

If lawmakers won’t do it, masses of their constituents will. Some in Massachusetts know how the political system works and have launched an initiative to garner support for the regulation and taxation of internet poker in Massachusetts. The group of activists is reportedly led by Randall Castonguay, a 41-year old resident of the state who also holds the position of Massachusetts state director of the Poker Players Alliance.The plan is to obtain enough signatures to secure a spot on the 2010 ballot for online poker legislation, which will require 66,593 unique names on the petition that must be submitted by December 7, 2009.
